Constitutional Litigation is the defense against violations perpetrated by state actors against Human Rights. It is one of the “guarantees” recognized and granted by the Mexican Constitution, with its latest amendments.
Constitutional Litigation refers to constitutional proceedings, such as the Amparo Action, Constitutional Controversies, Actions for a Constituional Review, and Class Actions (acciones colectivas), recently incorporated to our Magna Carta, before federal bodies, such as District Courts, Collegiate Circuit Tribunals, and the Supreme Court of Justice.
We are experts in Constitutional Litigation since we provide counseling, day to day follow-up, and processing in constitutional law disputes, in an adequate, comprehensive, and complete manner. We are capable of understanding, not only the legal implications of the cases we represent, but also the political ones, as well as the new legal model of the Constitutional Rule of Law and its impact in the everyday practice of the Law.
We provide Constitutional Litigation services consistent with the drafting, filing, and processing of amparo actions before the Federal Courts having proper jurisdiction, such as District Courts, Collegiate Circuit Tribunals, and the Supreme Court of Justice.
For that reason, we provide the following services:
Amparo Action: We give legal counsel to individuals and corporations in the drafting, filing, and processing of amparo actions to challenge rules, acts, omissions, judgments or resolutions finalizing a trial proceeding, which are contrary to the provisions of the Mexican Constitution and/or the international treaties on Human Rights to which the Mexican State is a party thereof, including obtaining interim measures and injunctions in order to protect the interests of our clients during the processing of the lawsuit.
